Saw your story on Autoblog and had to stop by and wish you good luck... and to let you know I emailed their sales team to tell them to do the right thing. The story is spreading and this is going to take off quickly. If they don't make this right soon, I bet they're going to be bombarded with emails and phone calls from ticked off interweb car guys. I'll post the response to the email if/when I get one. Until then, the world is watching.

'The Internet Manager for the seller, Eric Manley of Glenn Hyundai in Lexington, Kentucky, claims the car was only listed at a "Buy It Now" price of around $19-20K and, because no one purchased it at this price, the car was removed. Other than stating this is the case there seems to be no evidence backing this up as of yet.'

McFly clearly won the auction via bidding and it was not taken down prior to his winning.

edit: Yikes, so they have the lawyers on your back already McFly? Whether you wanted it or not, it looks like the fight is now on. Hopefully you're prepared to take them on. Even if you're not, you've got us on your side so if there's anything you need, just ask. With any luck there should be some lawyers out there reading this story who can lend you their services.

I would say get a lawyer, if you don't have one yet. Don't listen to their lawyer, he is just trying to scare you. Once you have your lawyer contact them, they will back off. There is absolutely nothing illegal in what you are posting on the websites, you are free to express your opinion about someone or something. Even if you sue them, it won't get to court. It will be settled before that.

Get a lawyer. Contact Hyundai of America. While it won't exactly lead you to getting a free car, this will put a big dent on them since they are the ones approving their dealerships. Put the media on it, CNN loves stories like that.

But whatever you do, DO NOT listen to their lawyer. They have no legal stand in this chaos, absolutely none. You won it, they are under legal agreement to sell it. You didn't bid on a pencil, you bid and won a car auction. They see that you probably have no lawyer, so they are just trying to scare you off. My serious recommendation, get a lawyer. Explain the situation to him/her.

Spread it among as many sites as you can, nobody wants bad rep. And stories like that usually turn out in favor of the buyer, ones media and websites are involved.

the lawyer scaring you tactic, shows you got them by the short and curlys.. You have done nothing wrong, they have nothing libel or slanderous against you, you conducted yourself well and as long as you spoke the truth, they got nothing on you.. I can't speak for the other members.... That one guy with the "do not call them" knows, he is smart. Though just to be on the safe side I would hire a lawyer (if you haven't already) and make sure he scans the threads and makes sure you good and has a prepared for what they might accuse you of. As far as I know, everything you posted (adresses and phone numbers ect) is public domain, so you are safe there too. But I am no lawyer, so be safe.

good job man, do this for all of those that have got screwed by a dealerships in the past!

McFly, they're trying to scare you, trust me. What you really really should do now, is GET A LAWYER...if they're threatening you with legal action, then you need to get an attorney, ASAP, and throw it back in their face. Also, there are jurisdictional issues at play here (easily resolved, but his particular attorney most likely cannot directly sue you unless he's licensed in your state). Dont back down, now is the time to step up!

McFly - best of luck to you. I can't encourage you enough to stick to your guns, contact a lawyer, and be ready to come away from this with your car. No other options are acceptable. Dealerships are shady as hell and it's disgusting what they get away with. On behalf of myself and anyone else who ever has, ever will, or ever might attempt to enter into a business transaction with a dealership, I applaud your actions and trust me when I say that you have the entire automotive enthusiast community pulling for you.

This made it to the Evo community as well. Good luck with everything McFly, and get yourself a lawyer. I'm personally going to call the dealership tomorrow and ask them why they dont honor their sales contracts made on ebay.
