Best of luck to you then, I won't contact them still but more in case that might fubar any legal procedings that may happen. I do hope all turns out well though, really is obnoxious that they wouldn't honor the deal at all. Do sincerely hope you either get the car for the $16,125 or at least get something fair in compensation. Oh and lawyer's fees and lost time, plus whatever expenses you have for planning to travel to them in December to get the car.

Anyway, I don't have a Somethingawful.com or 4chan account. BUT..well...if someone did have an account with one of them, you can't exactly stop them from posting there...I figure as long as you don't encourage people to do so, you're fine...

Tell your lawyer to write a letter to Hyundai. If properly written, a simple piece of paper can do a lot. And I wouldn't talk to Consumer Affairs. Address the letter to someone in the higher up. People in Consumer Affairs can't really do anything, it's the higher ups that grant or deny. Trust me, a simple letter will do things.

I was in a situation once with the cops, I wrote a letter, gave it to my lawyer and that letter went to chiefs of 2 different police departments and higher up in my university. Week later, I received an apology. In your case, it won't be just an apology, I hope.

But you know your situation better, I hope your lawyer will help you out. And negative feedback on ebay won't really do much. They'll just give a negative feedback to you, and that's it.

Here is my contribution...

Here's my contribution:

Some people have been claiming that this car auction falls under the non-binding agreement rules on ebay.com.

Due to this statement (http://pages.ebay.com/help/policies/non-binding-bid.html):
Quote:
Why does eBay have this policy?
In most cases, a bid on eBay is a legally binding contract between the buyer and the seller. Due to state laws and complexities in certain real estate transactions, bids on some categories of Real Estate and motor vehicles on eBay are non-binding.
So I spent some time learning more about it. The link most people refert on Ebay strictly states that some realestate and auto auctions could be non-binding due to specific state laws. So after a little research I found a site that lists Kentucky's binding/non-binding auction laws. Here is the link regarding the binding nonbinding sale via auction of realestate (and I am assuming autos would be the same):
Real Estate Auctions | Todd MacMillan, ABR, CTA, ERS, GRI | MacMillan KY Real Estate | ERA Georgetown Kentucky REALTOR®

Which says:

Quote:

Absolute Auction

It is the auctioneer's and the auction house operator's responsibility to make sure that the seller fully understands the law regarding absolute auctions. After the auctioneer calls for bids on an article or lot, that article or lot cannot be withdrawn unless a bid is not made in a reasonable time. An auction without reserve means an absolute auction. 1. An auction cannot be advertised absolute or with similar meaning unless (a), (b), and (c) are met. (a) There cannot be any liens or encumbrances, except current taxes; or All lien holders sign the absolute auction contract or a binding commitment agreeing to sell to the highest bidder; or A financially responsible person, firm or corporation signs the absolute auction contract or a binding commitment to guarantee that the liens will be paid regardless of the high bid. AND (b) There must be a bona fide intent to transfer ownership at the time of advertising and at the time of the auction regardless of the bid or bidder. AND (c) The listing contract must state that the auction is absolute or without reserve and that in no way shall the seller, or anyone on the seller's behalf, bid. 2. The above does not prohibit: (a) A secured party from bidding as long as this does not establish a reserve. (b) An individual involved in dissolution of marriage, partnership, or corporation from bidding following that dissolution. (c) The non-misleading advertising, with equal emphasis, of absolute and reserve items in the same auction. 3. Except as noted above, the seller may not bid at an absolute auction, nor may anyone bid upon his behalf. A licensee shall not knowingly receive such a bid by or on behalf of the seller.
Dude after finding that I think your GOLDEN!

I just realized in their own ebay ad they state:
Quote:
Disclaimer: This auction is a legally binding contract to buy this vehicle. All vehicles are sold as-is unless otherwise specified. I have done my best to accurately describe this vehicle. It is up to the buyer to come see and further inspect the car before the end of the auction.
So See above and they are screwed... contracts can not be binding one way and not the other...

Complete random question, is there a Blue book or NADA price estimate for the 2010 Genesis? Or is it still too new of a car to have a used car value posted on their sites? I guess I'm curious to see how far of $16k is from the used value of this car, mostly to see how petty they are being. I would assume $16k is under blue book, but I can't see it being THAT under. And I bet if the OP was going to their dealership with a Genesis to trade in, they would try to convince him to take 16k or even less.

Not yet. Still too new to be listed on KBB or NADA. NADA has the info in their system but it comes up N/A with the prices.

exactly, he hasn't done anything but post truths and facts about his expereince, if a few crazy people out there decided to go further, he is NOT responsible for thier actions and GH is lucky he was able to get them to stop.

Just as if I said smoking is bad, and then someone said I hate all smokers, and then someone else said they should all die, and someone burnt their bulding down..... I would not be one bit responsible, nor would any legal actions against me hold up in court even slightly.

so IF people decided o bombard them will calls again, it could effect an out of court verbal agreement if part of the agreement was to get them to stop, but it can in no way effect anything legal, other than making it hard fo them to do business with all the phone calls. Also why saying don't call this number 1800xxxxxxx, is safe to say., you can't control what people do. the only problem you coulr legally run into if they wanted to track you down, which is very difficult to do legally online (if you didn't rip someone off lol) is go after you for posting thier phone number, but as long as it is public infomation, they can't even go after you for that.

This thread has me completely fed up with Hyundai. I've been shopping for a Sonata for my girlfriend during the past few weeks, but this weekend, I just said "**** it" and decided to look for a different car. During my car search I had called/emailed about six dealerships about Sonatas.

Every one of them followed up with me because I said I was buying on Saturday. To each Hyundai dealership that followed up, I sent back an email with a link to the AutoBlog entry for this event and a comment about how I don't feel as though I should do business with a car company that allows their dealers to treat customers like that.

They all sent back replies about how they have "100% Customer Satisfaction" and other BS, but maybe it made an impact. Though, I doubt it.

yea, to Hyundai comsumer affairs or whomever.... It might not be your fualt that this happened, as you have no control over what they do really. But when something like this happens, and you do nothing to keep them in check, THEN, it goes agaist your good name.
Once you know about it, and do nothing about it, its almost like condoning it...

McFly, I've decided that I am angry enough because of this thread that I'm going to send out the following letter tomorrow morning. I tried to post it through the web on their site, but it has a character limit of 400 characters.

Quote:
To Whom it may Concern:

Recently, I have begun shopping for two cars: a sporty one to replace my aging Subaru WRX, and a comfortable sedan to replace my significant other's Taurus.

After reading and hearing all of the hype about the Genesis Coupe, I was intrigued enough to seriously consider it. It took one out for a test drive and loved it. For the price, it is a wonderful deal for someone looking for a luxurious, sporty car. I decided that I should join an online community for Genesis Coupes to get an understanding of what owners think about their car.

Most owners' attitudes seemed to be genuinely positive with their cars. This made me feel confident in my decision to purchase a GenCoupe. As time progressed, I started to notice an ever growing population of users reporting extremely poor customer service from dealers and a general unwillingness to fix problems with their cars without constant nagging.

This bothered me a bit, hearing how much many owners hated the way dealerships were treating them. It certainly wasn't enough to sway my decision to purchase such a great car. However, a recent post on the online community, GenCoupe.com about Glenn Hyundai, has. You may be aware of this event, as it has been featured in every major automotive blog on the Internet -- Autoblog, Jalopnik, etc. If you haven't read about it, a quick Google for, "Autoblog Glenn Hyundai" has the article as the first link, and Googling, "Glenn Hyundai" has the forum thread on the first page. Otherwise, I've linked to it at the end of this letter.

The behavior of this dealership has very much hurt the reputation of Hyundai in the eyes of many, and it has certainly cost you a customer -- myself. Normally, I wouldn't take the time to inform a company of their poor decision making; instead, I leave it to the market forces to drive such companies into irrelevance.

What changes my mind about this practice is Hyundai's courage. A car as wonderful as the Genesis Coupe really displays a type of character that isn't often seen in this industry: a willingness to listen to customers and give them what they want, not what a committee decides they should. I want to let you know that people love the GenCoupe; to tell you that people would love to buy one, but are being held back by the fact that they are being treated as less-than-human by dealerships that represent YOUR company.

When sales of the GenCoupe are poor, don't blame it on the car; it's perfect and people want it. Instead, blame the people who represent Hyundai -- and yourself.

I will be providing this letter in its entirety to the members of GenCoupe.com, in the hope that every potential customer that feels the same as I do decides to let Hyundai know. When enough of these letters come in, I know that a company like Hyundai will listen to us and fix this problem.

Thanks and Regards,

Brian

That is too bad that they did not uphold their part of their agreement. I's very puzzling that Glenn Hyundai would back out, considering the onslaught of calls and hellish wildfire that ensued as a result of your story.

I for one do not want to do anything to jeopardize your chance to buy the said coupe for the winning amount, but I sure as hell want to do everything in my power to make sure justice is served and Glenn Hyundai has a very hard time selling cars from now on.

Now that you've got a lawyer and some backing you should hit up the local news. I'm sure they can do an inside story. It'd be great if the "stealership" would decline to comment. LOL!

$3,000, that's all that it is, on a mistake by their Internet Manager. Instead going to give up hundreds of thousands of unsold cars due to bad publicity. Shame Shame Shame. The owner should take economics 101
