Also, please stop any discussions regarding this matter, AND please stop any and all phone, calls, emails, communications, etc with Glenn Hyundai regarding this matter. Do not bother them here forward, in other words.

What is posted in the first post of the thread is all I am allowed to say. It's resolved, and we are both satisfied. If Glenn decides to announce more, it's up to them. But, the agreement we have is that I will only state what I've posted. I wish I could say more, but as hard is it is to do, I can't say more.

Jalopnik, is making assumptions. I haven't told them anything except for what is on the thread. People can derive what they wish, but what's on the thread is the truth, and all I can say

Everything has been finalized, successfully. You can quote me on that, and post that if you could. Or just edit my post and put that in after the first part.

If the dealership didn't want to sell the car, they should have ended the auction early if they felt their minimum wouldn't be met. They REALLY should have set a reserve, but I understand the attraction of a "No Reserve" auction and how it creates bidding wars that a reserve auction does not.

Ebay is not craigslist. Ebay is legally binding. In this matter, the dealership screwed up, and if the buyer really wants to press the matter, he will eventually win. The dealer needs to look at what they will lose on the car, and compare that to what they will spend in legal fees to defend against a suit that they will clearly lose. I doubt that they would even lose much since its a used car, and they probably raped whomever traded it in, defaulted on it, or whatever happened that its back at the dealer with 4k miles.

I know times are hard right now, but bad press is going to make them worse. I would hate to see a whole dealership closed down just because a few people can't swallow their pride and honor their ebay contract to sell the car for the winning bid.

lol, your not gonig to get anything for "emotional stress", or "wasting your time".

Either you get the car for the specified amount, or you/a lawer works out a deal with the dealership to come up with an agreed amount.

People who sue crazy amounts of money for "emotional stress", etc make me sick. No wonder this country is so f*cked up.

I agree it is BS, but if that is what he has to threaten them with to get them to give in, I say use it. I think he should get $25k settlement, 23$ to buy a new car, since this is probably already sold, and 2k for lawyer fees ect.

But if they don't want to settle, $100k law suit seems good to me..... If they can't man up to their mistake, I have no problem screwing them out of a bunch of money.

I do think sueing mcdonalds for making you fat is BS, and emotinal distress is abused to no end, but this would be a legitimate reason for using it IMO.

I don't see anywhere that he asked for anything extra back. Just the car for what he paid for it.

Please dude, go read the BMW thread, at the very least the OP's posts and his lawyer's posts, and then get back to us.

He does not need to buy another vehicle and sue for the difference. He has a legal contract that a vehicle was being sold from a dealership to him for X price. Regardless that money has not yet changed hands other than the deposit that he had, the dealership is now in breach of contract, giving McFly a legal opportunity to sue. This isn't exactly hard to understand, nor is it nearly as complex as you're trying to make it since he's already said that all he wants is the car.

Now please, are you really that stupid, or are you just trying to troll this along to see how much you can get out of people here?

Removal of jsinton

Everyone,

I have asked the moderators to remove jsinton from the forums; his input and comments are not helping anyone and it is obvious that he works for the accused company.

McFly keeping up the fight; obviously you have a case or jsinton would not be in the forums trying to turn the forums against you. Also, call Ebay again and talk to a manager send in your contract to them. Since Glenn Hyundai is actually selling across state lines and making legal contracts I think that this could fall under federal guidelines. I would check into federal guidelines over internet sales.

McFly, I also forgot you can file a small claims lawsuit and you do not require a lawyer. As long as you are seeking a monetary settlement under $5,000 (in most states) you can file online in most states for $50 or send in the lawsuit via Fedex. The courthouse will have the sheriff department deliver the lawsuit to the dealership and they will have 30 days to respond to the court. The court will review the case and make a determination; they may require a telephone conference or video conference with the judge but overall you won't spend over $100.

If you guys feel that someone on here is "The Dealership" in question you could ask for the admin to check ip's.

If the ip just happens to be located at the dealership you've got some major power there. There have been several documented cases where "Company Representatives" have tried to combat over the internet in secret. If they've done it thru a company computer they can be found to be representative of said company. It's a corporate rule about having access to a company network... with access you represent the company. That's why most work emails have disclaimers and privacy notices at the bottom.

Also... for less than a few bucks you can start the lawsuit. It then has to be taken seriously. Since you had a legal binding contract it's an open and shut case. Also, didn't you say they charged a 500 deposit to keep the car for you? If you can show that charge it will stand as further proof of acceptance/approval of the contract terms.

It will be hard to get compensated for the loss if the dealership has already sold the vehicle. However, the fact that they did sell it when there's a binding contract could constitute a breach in terms. Under this breach you could be awarded the some of the sale plus court/attorney fees. Most likely, since it's a Hyundai dealer, the Judge could press for like compensation. Meaning they'd have to give you a similiar car. He could rule it be new or just rule that it be comparable in all fascites. Then the dealer would have to find a car to fit the bill, show proof to the court, and get approval from the plantiff.

It will be long and complicated but with the right attorney you can go far.

As for going thru the DA of Kentucky, I wouldn't. Instead i'd file suit and that will automatically get the attention. After all, the DA's office has way to much of a case load to consider yours. Even though they should... they'll probably back burner it. Once filed and hearing set you'll probably get an offer from the Dealership.

Ebay can/will back you in court. You just have to subpoena them. Use a certified Server to do so. Also try to subpoena Hyundai Corp. The Dealership is usually housed under "Franchise Law" but still bound by Corp standards. Your attorney will know if this is best.

Lastly... You can use the News in your favor. As long as you let them commit any slander. You stick to the facts. Usually the newsgroup you're dealing with will keep things within legality as they don't want sued as well. However printed news tends to get close sometimes. You'll usually have to sign a copy of the transcripts. READ them fully and ensure they don't have you committing and slander or lible.

Hope this helps and I really do hope you can get thru this. In the end... fight the good fight, and use this as a lesson before your next purchase from out of state hands.

Probably should print was this Jsinton is posting, or at least get some sort of hard copy evidence of it. If you get his IP address and if he is near or even at the dealership, I am sure that a judge in small claims court would at least find it humorous that he is trying to discourage you from trying to get your car.
