Technically if a car comes from the factory with a muffler it needs to have one on it.
With that being said, mufflers won't make you fail emissions for high contamination. Mufflers are for sound control.
My SRT-4 came factory with no muffler. In MD I seen cars pass no problem with mufflers removed.
Give a different emissions shop in your state (doesn't matter how far away it is) and ask if it will pass with muffler straight piped. Don't wanna call the one you go to.
I would just go and see what happens. If it fails put a muffler on and then remove afterwards. If not? Well then your golden.👍

Copied directly from Maryland's emissions website
Should apply to you as well.

The muffler is not an emission control device so removing it will not affect a smog test.Jul 1, 2014
