thinking about purchasing a BTR ECU that has been fine tuned at one of their tuning event. I have the same supporting mods as the tune. It's not a canned tune but fine tuned for his engine. Since we have same engine/mods is it safe?

Not sure I'd want to run a custom tune from someone else's car but it will most likely be safe if you have the exact same mods. Different brand of mods and I most likely wouldn't want to. If his fmic performs better and BTR was able to increase timing because he has cooler IATs, and you don't, you might get some knock/detonation.
The results of a tuners canned tune is what they feel is safe to run on just about any car. A custom tune is what that tuner feels is ok to run on one particular car because they could verify it was safe.
Exactly what i was thinking, just wanted more opinions.
Its true we do have same engine/mods but every engine is different and his AFR's could be totally different from my AFR's at any given point so i was skeptical.
judging by his for sale ad, the only mods he had was
a short ram intake (pretty much cant mes that up manufacturer to manufacturer)
a 3" turbo back exhaust with no cats. (again, not a whole lot of difference between exhausts)
and stock everything else.
only thing i would wonder is where are you located? he is in OC, Cali so if you are in a much hotter climate, you may get higher IATs which could mess with timing.
