It was about 2 in the morning i got off work im at this red light no cars anywhere to be seen. I do a burnout, on down the road this car right on my butt. Then i see the lights oh **** and I get a ticket for reckless driving. How's that suppose to work nobody was around?

My guess is because is that you could harm yourself if you loose control. I think any display of that type of driving on a public road regardless of numbers of cars around you qualifies. That sucks.........

Yeah, i suppose so. Hard to lose control going straight but maybe he didn't know that. I was thinking maybe a careless driving ticket but not reckless

reckless driving is any time when the opperator has willingly sacrificed vehicle control, ie; doing burnouts, drifting, powersliding, doing a wheelie, fishtailing and pretty much any other tomfoolery.

start by buying a different car or throwing a ton of cash into this one.. then weigh down the car behind the rear axle with about 2-300 lbs. Put the car into first, load up the engine, ease the clutch a bit to load the drive train and then dump it. She'll lift up.

In Texas if you get cited for wreckless you would have spent the night in jail, although you were breaking the law, he definately overdid the ticket. I would have told you to knock it off and sent you on ur way.

It would have been nice if he would have said, "nice car." Just cool-it around these here parts, please.

Unfortunately he was thinking...QUOTA! Now I can go to Dunkin' Donunts!

Actually, a simple burn-out can be called reckless driving but that is a cheap shot in my view. Excessive speed or drifting around a corner is more consistent, though you could try the "Korean drift car" excuse. Hey, if you are not a hot blond it cannot hurt.

I thought burnouts were officially classified as "excessive display of horsepower" not reckless. I'd fight for a lower charge.

#13 ·
You got lucky I think.. Two of my friends in CA got cited for destruction of property for doing burnouts, and both were $1000+.. One tried fighting it, but he lost.. Hey, you do something you are not supposed to and you got caught. Suck it up, move on.

But your in a rwd 'sports car' not a civic or something. If your willing to do a burnout at a stoplight with no one around the cop has to say to himself, ' what else is this guy willing to do on public roads with no one around in a car like this.' In a sense he could just be covering his own ass if in the future he finds your car in the side of a house, another car, or a human person. I'm betting you will think twice before doing anything 'reckless' in the future, you may still do it, but at least you'll be using your head and the adrenaline isn't just burning extra hot which is all I ask of people who do what they do on the streets.

To sum up. I don't care if u street race, drift, or do burnouts just make sure you are in control and know your limits, not just trying to prove yourself to someone or some stupid **** like that.

aw poor widdle gangstar wid all his cash monies in his avatar got caught and has to pay the consequences :*(

really? who does a burnout all by their lonesome at 0200?

I could totally understand nailing a twisty little backroad at a million miles an hour in the wee hours of the morning because you could, but smoking your tires all by yourself?

were you deprived of precious moments of oxygen at birth?

#19 ·
Obviously someone was around if the cop pulled you over... You just didn't look hard enough.

#22 ·
This! And if you are not smart enough to notice a cop before you do a burnout I feel sorry for the next pedestrian who crosses your path.

Iv got to say, I'm very impressed with this forum. When I read the title to this thread i was expecting a lot of cop bashing. But instead there is a lot of level headed mature responsible people posting their thoughts.
As for the op, tough break brother, **** happens just got to pay up for it. The cop was just doing his job.I myself rather spend time catching a real burglar or robber but that's the beauty of the job, we have discretion....

+ 1, its up to the mos if he wants to admonish or write a summons for the infraction.....maybe a family member of his was killed by a wreckless driver. who knows...:gc-wmscared0016:

If you're in Cali, try doing a Trial by Written Declaration. Much better chance of getting your ticket dismissed than fighting in court because cops get paid to go to court and their lazy asses don't get paid for doing the report at home.

Hey, you got caught. Don't be a puss about it.

If you've never had a ticket before usually you can take a copy of your driving record with you to court and get it reduced to improper equipment which is a non moving violation but you still have to pay the fine. At least it won't be points against your license. I would print out your driving record and talk to the district attorney unless you know a cop that would call the officer and talk to him on your behalf about reducing it before court. That's what I've had the best luck with. Sorry to hear about it and hope that helps.

The bad part is you did the crime but at 2am how much other worse **** is going on that he could have prevented instead of harassing you. I wouldn't bring that up though. Lol

no need to bring driving record, the judge has a screen in front of him with all your info on it. thats how they judge how much the fine is based on your previous record. just look decent hand the ticket and your liscense to court recorder and wait for your name. when you get up to the bench just be polite and articulate dont offer any info other than what is in your testimony. and if you do get off light dont try to shake the officers hand... i hate that! nothing personal it just looks bad in front of judge.

#33 ·
You break the law you get a ticket.... seems fair to me. I wouldn't bother trying to get it reduced... theres no arguing a burnout.

#35 ·
I know i broke the law i will still try to get it reduced to careless driving. Atleast it won't hurt as back as reckless driving because its only 2 points instead of 4

^^^^ law is not black and white. Lawyer up and you might be able to get off with probation , community service hours , and a clean record if you abide . Shoot at least get it knocked down to negligent... A dumb ass attorney should be able to accomplish that at least.

Lucky you dont live in Ontario, burnouts fall under the stunting law and gets your car seized on the spot. (as it should)
Discretion has no place when it comes to dealing with people driving like idiots on the road. I dont know how many accident scenes I have dealt with that the driver "knew what he was doing". And FYI... you doing it at 2am has no bearing on it, most street racing accidents happen after hours.
Want to drive really fast like you see in video games and movies? Do it on the track. Dont risk my family and friends lives because you want to be cool.

No simpathy here.

The different citations are from different states, and different requirements in order to cite. I am not sure what state you are in but reguardless you did break the law, did the officer go a little overboard, IMO yes but was still within his rights to cite you for wreckless.

The courts I have been to you talk to the da before the judge and I always work somethin out with them before seeing the judge. That way he says the violation you have worked out with the da. You plead guilty, pay the fine and on your way.

I have no idea how the system works over here, but I would say that a ticket is excessive. Should have been a warning. You Americans seem to have an odd sense of what is dangerous in traffic and what isn´t. Doing a slight burn out at 2AM clearly isn´t in my book as you worst case end up damaging you car or perhaps you. A calculated risk.
On the other hand, in daily traffic the following is commonly accepted (many do it and no one displays discontent about it besides me):
- Weaving multiple lanes due to not paying attention and whoops-this-was-my-exit
- Talking or texting while driving
- Catching way to yellow lights (reds are also seen almost daily in prime time traffic)
- Not keeping distance to the car in front of you (2 sec rule)
- Completely ignoring merging and yielding rules, especially the legal right turners from parking lots etc. who can´t judge oncomming traffic speed and don´t floor it when they still choose to do the turn even though they shouldn´t
- Allowing +10 mph as the rule of thumb as to how much above is tolerated before you get a ticket. +10 mph applies to all speed zones even though some would argue that adding 10mph to 35mph is a lot compared to doing the same to 65 mph.
- Going 15-20mph faster than the speed limit (and yes everyone does around my house and no I don´t because I drive on a foreign drivers license and yes trucks constantly harass me for driving the listed speed).
- Real reckless driving and speeding in cars not built for it (run down beaters, heavy trucks etc.)

This is just the things that annoy me daily that I care to write down. All of it is way more dangerous than what is described by OP, but sadly I rarely see anyone being pulled over by a cop for this kind of behaviour.
And don´t get me started on all the small things like left lane driving on highways, people not removing themselves from obvious blind spots and similar daily curtisies.

No speed limit and 100-110mph cruising on highways and interstates work fine in Germany, I guess danger is all relative. You just make some odd judgement calls in my book.
